Joanne Donald, family solicitor with emeryjohnson, has qualified as a Resolution Mediator, swelling the ranks of specialist mediation professionals to just 60 across the Midlands.
What is Mediation?
Mediation provides a safe environment in which to discuss any issues which might arise as a result of your separation. All discussions are confidential although you will be encouraged to discuss issues openly and frankly. Mediators may not give advice, but may give legal or financial information. Mediators will help you ensure that your proposals are realistic. You may be recommended to consult your solicitor during the process, if an issue arises, to establish what is in your individual best interests.
When mediation is complete, a written summary of the proposals will be provided. This will be forwarded to your solicitor if you have one, to be incorporated into a Court Order or a legally binding agreement.
Who can attend mediation?
Couples, whether married or unmarried can attend for mediation at any time before, during or after separation or divorce, if there are issues to settle. There may be difficulties concerning money matters, property, arrangements for the children.
Mediation is also available to grandparents. There is no discrimination on grounds of race, culture, ethnicity, disability or sexual orientation.
What are the benefits of mediation?
Mediation can help you communicate, negotiate, make decisions and resolve disagreements about the children, finances and property and avoid the need to go to Court which can be very adversarial, timely and costly. Mediation is generally a faster, more economical, way of resolving your differences as opposed to fighting through the Courts. Most importantly you will retain a greater sense of control over the process and the outcome. It is you who will come to your own agreement over what is best for you and your family as opposed to the Court.
How much does it cost?
Private mediation costs £105.00 plus VAT per session per person. To resolve matters through the traditional route of instructing a solicitor, costs on average are between £125.00 to £210.00 per hour, depending on experience and length of qualification. Mediation is therefore an attractive way of resolving issues as opposed to more conventional representation.
